1. General Provisions

These Terms of Service ("Terms") regulate the use of the EveryMailFinder service ("Service"), offered by Noël Wydaeghe ("we", "us", "our").

By creating an account or using our Service, you agree to these Terms. If you do not agree with these Terms, you should refrain from using our Service.

2. Description of the Service

EveryMailFinder is a tool that enables users to extract email addresses from websites through an automated process ("scraping"). The Service includes:

• Processing CSV files with website URLs
• Extracting email addresses from these websites
• Generating an output CSV file with the found email addresses
• Account management and subscription management

3. Account Registration

To use our Service, you need to create an account. You are responsible for:

• Providing accurate and complete account information
• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Immediately reporting unauthorized use of your account

4. User Obligations

When using our Service, you agree to the following:

• You will only use the Service in accordance with applicable laws
• You are solely responsible for the legal aspects of email scraping
• You will comply with GDPR, CAN-SPAM and other privacy legislation
• You will not apply misleading or fraudulent practices
• You respect the terms of service of the websites you scrape

5. Prohibited Use

It is strictly forbidden to use our Service for:

• Illegal activities or activities that promote illegal behavior
• Spam, phishing or other forms of unwanted email sending
• Collecting data from minors without parental/guardian consent
• Hacking, denial-of-service attacks or other malicious activities
• Violating intellectual property rights
• Activities that negatively affect the stability or performance of our Service

6. Subscriptions and Payments

Our Service offers both free and paid subscription options:

• Free subscription: Limited to 100 emails per month
• Premium subscription: Unlimited email scraping for €10/month

Payments are processed via PayPal. By purchasing a paid subscription, you agree to:

• Automatic monthly payments until you cancel
• PayPal's payment terms
• No refund for already elapsed subscription periods

7. Subscription Cancellation

You can cancel your subscription at any time through your account dashboard. When canceling:

• Your account remains active until the end of the already paid period
• No further payments will be collected
• Your account will be converted to a free account after the paid period ends

8. Intellectual Property

All intellectual property rights relating to the EveryMailFinder Service, including but not limited to software, logos, and documentation, are and remain our property or that of our licensors.

You only obtain a limited, non-exclusive, non-transferable right to use the Service as described in these Terms.

9. User Content

You retain all rights to the CSV files you upload and the generated output. We claim no ownership of the data you generate.

You guarantee that you have the necessary rights to process the uploaded data through our Service.

10. Service Availability

We strive for the highest possible availability of our Service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Temporarily make the Service unavailable for maintenance
• Add, modify or remove functionalities
• Terminate the Service if necessary

11. Liability

Our liability is limited to the maximum amount you have paid us in the past 6 months.

We are not liable for:

• Indirect damages, consequential damages or lost profits
• Damage resulting from incorrect use of the Service
• Damage caused by changes or interruptions to the Service
• Damage related to the accuracy of scraped data

12. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with Belgian law.

Disputes arising from these Terms will be submitted to the competent courts in Belgium.

13. Changes to the Terms

We reserve the right to change these Terms. Important changes will be communicated in advance via email or via a notification in the Service.

By continuing to use the Service after changes, you agree to the amended Terms.
